It is fun listening to people who don't know anything about the law comment on this. He is charged with Murder 2 and everyone wants to know why he is not charged with Murder 1. "Special Treatment" etc they are saying because he is on TV and radio. No folks. Do something crazy and read the law. Everything I have heard so far says that this is in fact Murder 2. Both Murder 1 and Murder 2 are premediated (the law says "specific intent") murder. The difference is that Murder 1 requires specific intent AND and an aggravating factor such as murder in the commission of another crime, or of a police officer or of a child under 12. I have not heard that there is any other aggravating factor as FOUND IN THE LAW ON MURDER 1. But, people start talking without any basis in fact or law and we have cries of special treatment.
